ENS Maxis is a collection of digital artworks (NFTs) running on the Ethereum network. This website is only an interface allowing participants to exchange digital collectibles. Users are entirely responsible for the safety and management of their own private Ethereum wallets and for validating all transactions and contracts generated by this website before approval.

 

Furthermore, as the ENS Maxis smart contract runs on the Ethereum network, there is no ability to undo, reverse, or restore any transactions. This website and its connected services are provided “as is” and “as available” without warranty of any kind. By using this website you are accepting sole responsibility for any and all transactions involving ENS Maxi's digital collectibles.

 

Ownership

i. Each ENS Maxis is an NFT on the Ethereum blockchain. When you purchase an NFT, you own the underlying ENS Maxis NFT. Ownership of the NFT is mediated entirely by the smart contract and the Ethereum Network. At no point may we seize, freeze, or otherwise modify the ownership of any ENS Maxis.

Personal Use

ii. Subject to your continued compliance with these terms, Water Labs LLC grants you a worldwide, royalty-free license to use, copy, and display the purchased art, along with any extensions that you choose to create or use, solely for the following purposes: (i) for your own personal, non-commercial use; (ii) as part of a marketplace that permits the purchase and sale of your ENS Maxis NFT, provided that the marketplace cryptographically verifies each ENS Maxis owner’s rights to display the art for their ENS Maxis to ensure that only the actual owner can display the art; or (iii) as part of a third party website or application that permits the inclusion, involvement, or participation of your ENS Maxis, provided that the website/application cryptographically verifies each ENS Maxis owner’s rights to display the art for their ENS Maxis to ensure that only the actual owner can display the art, and provided that the art is no longer visible once the owner of the ENS Maxis leaves the website/application.

 

Commercial Use

iii. Subject to your continued compliance with these terms, Water Labs LLC grants you an unlimited, worldwide license to use, copy, and display the purchased art for the purpose of creating derivative works based upon the art (“Commercial Use”). Examples of such Commercial Use would be the use of the art to produce and sell merchandise products (t-shirts etc.) displaying copies of the art. For the sake of clarity, nothing in this section will be deemed to restrict you from (i) owning or operating a marketplace that permits the use and sale of ENS Maxis NFTs generally, provided that the marketplace cryptographically verifies each ENS Maxis owner’s rights to display the art for their ENS Maxis to ensure that only the actual owner can display the art; (ii) owning or operating a third party website or application that permits the inclusion, involvement, or participation of ENS Maxis NFTs generally, provided that the third-party website or application cryptographically verifies each ENS Maxis owner’s rights to display the art for their ENS Maxis to ensure that only the actual owner can display the art, and provided that the art is no longer visible once the owner of the purchased ENS Maxis NFT leaves the website/application; or (iii) earning revenue from any of the foregoing.

 

Changes to Metadata 

The metadata of ENS Maxis NFT may be subject to change from time to time in line with the internal roadmap and plans for the growth of ENS Maxis.

 

No Guarantees or Future Promises

Whether through primary or secondary channels, by purchasing an ENS Maxis NFT, you agree that the art is what you receive. Any future benefits are ancillary to this purchase and are not to be taken into consideration with your purchase. You agree that you are not relying on any future commitments by Water Labs LLC in using this site and participating in buying, selling, or trading ENS Maxis NFTs.

 

Non-Investment Vehicle

ENS Maxis is meant to be a collectible Non-Fungible Token. It is not meant to be an investment vehicle. We make absolutely no promise or guarantee that these NFTs will be worth anything more than what you and the market deem the art to be worth. You understand that they have no inherent monetary value, and they should be treated as nothing more than a collectible with potential future value or lack thereof.

 

Taxes

You are entirely responsible for any tax liability which may arise from minting or reselling your ENS Maxis NFT.

 

Age Limit

You agree that you are over the age of 18 or above the legal age of your jurisdiction, whichever is greater.

Intellectual Property Restrictions

You acknowledge and agree that Water Labs LLC owns all trademarks or logos in relation to the NFT(s), and the purchaser has no right to use such trademarks or logos.

The Terms and Conditions above may be subject to change based on the sole discretion of Water Labs LLC.
